§ 18-36. Paving commission generally; paving to conform to regulations thereof.

  • The city engineer, the commissioner of public works and the chairman of the highway committee of the common council shall, by virtue of their respective offices, constitute the paving commission. Said commission shall prepare a map of the city of Syracuse showing all streets, thoroughfares and public places thereof, and thereon shall indicate the streets paved and the kind and character of the paving, as well as the streets unpaved. The commission shall likewise prescribe, approve and adopt and shall indicate on said map a general plan for paving all of the unpaved streets, thoroughfares and public places, and shall divide the same into separate classes, and by appropriate regulations shall prescribe the materials that may be used in paving the streets, thoroughfares, public places and parts thereof in each of said separate classes, and fix the standards of excellence and tests required for each such material. The said map, plan and regulations shall be filed in the office of the city engineer and shall there remain on file as a public record. The map, plan and regulations so adopted may be amended at any time as the commission shall determine, and said map and plan shall be altered from time to time so as to indicate additional paving completed and any changes in the paving regulations. From and after the adoption by the paving commission of such plan and regulations with respect to paving, no contract shall be awarded for paving any street, thoroughfare, public place or part thereof, except with some material therein specified for use on streets of the class to which according to such regulations it shall belong. Within the limits so fixed by regulations of the paving commission, and not otherwise, designations of materials shall continue to be made and shall have the same force and effect as provided by law. Prior to such classification of streets and designations of materials to be used in each separate class thereof, such commission shall, upon request of the common council, investigate conditions and adopt a regulation prescribing materials to be used in paving any street, thoroughfare, public place or part thereof, to which the request relates. During said period no contract shall be entered into by the city until materials shall be so prescribed, and the contract for paving must provide for the use of a material specified in such regulations.
