§ 20-26. City authorize to obtain water from Skaneateles Lake; authority to make contracts, own land, condemn property, etc.; private water distribution systems prohibited; franchises for water pipes.

  • The city of Syracuse, acting through its duly authorized officers, is hereby empowered to acquire, construct, extend, maintain, control and operate a complete system of waterworks to furnish said city and its inhabitants with water from Skaneateles Lake. It may contract for, purchase and acquire by deed, or otherwise, in its name all lands, waters, easements, tenements, hereditaments, rights, privileges, franchises and real and personal property of every name, nature and description whatsoever deemed necessary for the acquisition, construction, extension, maintenance, control and operation of such system of waterworks, and for securing the watershed and waters of said lake against any and all forms of contamination or pollution, with full power and authority to do any and all things necessary or proper appertaining to or connected with any of said purposes. Said city, through its authorized officers, agents and employees, is empowered to enter upon any lands or waters whatsoever for the purpose of making any and all surveys, examinations and investigations deemed necessary or proper for the purpose of carrying out the provisions of this act, and shall have the right to enter, appropriate, occupy and use any public highway, street, square, avenue, road or other public ground or place for the purpose of acquiring, constructing, extending, maintaining and operating said system of waterworks. In case said city shall be unable to acquire by purchase any property deemed necessary for the acquisition, construction, maintenance, extension, control and operation of said system of waterworks or for the protection of the watershed and water of said lake against contamination and pollution it is hereby authorized to acquire the same in the manner and by the procedure specified in title 1, chapter 23 of the Code of Civil Procedure, known as the Condemnation Law. Said city shall have full power and authority to do and perform all acts and things necessary and proper to enable it to acquire, obtain, furnish and maintain an ample and pure supply of water from Skaneateles Lake for said city and its inhabitants. No person or corporation, other than the city of Syracuse, shall furnish or distribute water through pipes, mains or conduits within said city. No person or corporation, other than the city of Syracuse, shall enter upon or excavate any road, highway, street or public place in said city for the purpose of laying pipes, mains or conduits for the conveyance of water except under a franchise from said city permitting the same.
