§ 43-5. Sale.

(a)

No person shall sell or offer to sell an aerosol spray paint can or broad-tipped indelible marker to any person under the age of eighteen (18) years of age.

(b)

It shall be the duty of any person who sells or offers for sale any aerosol spray paint can or broad-tipped indelible marker to require from any person desiring to purchase such paint or marker and appearing to be less than eighteen (18) years of age, identification and proof of such person's age before selling or delivering the aerosol spray paint can or broad-tipped indelible marker to such a person.
