§ 20-28. Right of other municipal corporations to use city's water supply and make connections to city's water system; charges for and regulation of such use.

  • Whenever the state board of health shall issue its certificate to the city of Syracuse, certifying that the water supply of any municipal corporation in the town of Skaneateles, county of Onondaga, is being contaminated by the waters of Skaneateles creek, and that the use of such water supply for potable purposes is detrimental to the health of the consumers thereof, such municipal corporation may present to the commissioner of public works of the city of Syracuse a petition in writing, showing the place and manner in which it is proposed to connect with the conduits and pipes in the city of Syracuse, the maximum per capita per day which it is proposed to take from the conduits and pipes of said city, and the maximum amount of water per day which it is proposed to take from such conduits and pipes. If such petition is approved by the commissioner of public works of said city, the municipal corporation making such petition is hereby authorized and empowered to lay the necessary mains, pipes, valves, hydrants and other necessary appurtenances for the use of such water and the city of Syracuse is hereby authorized and empowered to supply water not required for the inhabitants of the city of Syracuse to the inhabitants of such municipal corporation for potable purposes. The connections with the conduits and pipes of the city of Syracuse must be made at the expense of the municipal corporation making application to the city of Syracuse and must be made under the supervision of and in a manner provided by the commissioner of public works of said city. Such municipal corporation shall pay to the city of Syracuse water charges at the same rates as are charged by the city of Syracuse to persons using water in that city. The commissioner of public works of said city is hereby given authority to make reasonable rules and regulations governing the uses of said water, including the installation of meters and other devices for ascertaining the quantity of water thus taken. The provisions of this section shall not permit the supplying of water to any portion of the town of Skaneateles now supplied with water by a water company operating therein.
