§ 20-29. Right of city to furnish water to schools, hospitals, etc. outside city; rates, charges, etc. of such service.

  • Upon the written request of the board of trustees or of managers or other governing board or officer of a school, hospital, almshouse or other public or private educational or charitable institution, located within a radius of two (2) miles from the city of Syracuse, and upon the written approval of such request by the superintendent of the bureau of water of such city endorsed thereon, the board of estimate and apportionment of the city, in its discretion, may determine that water, if any, not required for the inhabitants of the city shall be supplied to such school, hospital, almshouse or institution, but such privilege may be revoked or suspended by such board of estimate and apportionment at any time. If such determination be made, the city, by its bureau of water, shall make the connections with the city mains and conduits and shall lay and install all the necessary pipes, conduits and appurtenances leading therefrom to the premises to be supplied with water; and the city is further authorized to construct and maintain pipe lines or conduits from existing pipes or conduits within or without the city limits and to enter into such agreement or agreements, with or without consideration, with other water companies, districts, or corporations operating in the county of Onondaga for the use of the latter's water supply pipes, conduits and distribution system as the city may deem required or advantageous in carrying out the powers herein granted, and the expenses thereof incurred by the city shall be paid to the city by such board of trustees or of managers or other governing board or officer of the school, hospital, almshouse or institution; and they also shall pay to the city for the water supplied such rates or charges as the board of estimate and apportionment may fix, not less, however, than fifty per centum more than the applicable amounts charged by the city to schools, hospitals, almshouses or other public or private educational or charitable institutions using water within the city. Such board of trustees or of managers or other governing board or officer before any expenses are incurred hereunder by the city shall give bond to the city, approved as to form by the corporation counsel and as to amount and sureties by the mayor, conditioned for the payment to the city on demand of the amount to be expended for making such connections and the laying and installation of such conduits, pipes and appurtenances, for the payment when due of the rates or charges for the use of such water and for compliance with the rules and regulations of the superintendent of the bureau of water under this act. Meters for measuring the quantity of water taken under this act shall be installed in such places and in such manner as the superintendent of the bureau of water may direct; such superintendent may make reasonable rules and regulations respecting the kind and installation of meters, the maximum quantity of water to be taken and any other matter necessary for the protection of the city.
