§ 25-7. Procedure for authorizing additional licenses.

  • Certification and authorization of additional ground transportation licenses shall be effected in the following manner:

    (a)

    The chief, upon his own initiative, upon direction of the common council, or upon written request by an applicant, may conduct public hearings to determine whether public convenience, necessity and welfare require the operation of additional ground transportation services and the issuance of additional ground transportation licenses. Notice of such public hearings shall be advertised in a daily newspaper published in the city, once a week for two (2) consecutive weeks. The hearings shall be held not less than four (4) nor more than ten (10) days after the date of last publication of such notice.

    (b)

    A determination of the question of the need for additional ground transportation services shall be made only after consideration of requirements or demands of the public, existing transportation facilities, traffic and parking conditions, potential congestion of traffic and such other relevant facts as the chief shall deem advisable or necessary to take into consideration.

    (c)

    If the chief shall determine, after such a public hearing, that additional ground transportation licenses are necessary, he shall thereupon request that the common council certify the number of additional ground transportation licenses to be granted.
