§ 38-3. Special assessment.

    All properties, except as otherwise provided in this section, situated within the aforementioned district shall be subject to assessment for improvements to be constructed within the district. The cost of such improvements need not be assessed uniformly against properties within the district. Properties included within said special assessment district may be assessed according to a formula established by ordinance which in the sole judgment of the common council reflects benefits accruing to the various properties within the special district by reason of such improvements. Such formula, need not be uniform for each improvement. In no event, however, shall properties within the special assessment district be assessed for capital improvements of a total cost exceeding three million dollars ($3,000,000.00).

    The common council may determine that the improvements constructed within the said special assessment district as heretofore provided shall be operated and maintained; that additional maintenance and other additional services required for the enjoyment and protection of the public and the promotion and enhancement of the district whether or not in conjunction with improvements may be provided; and that the cost thereof shall be assessed to the properties within the special district except as provided in this section. Such additional operation and maintenance of improvements and other additional maintenance promotion and enhancement services may be of the kind and nature already being performed by the city and the cost thereof shall be in addition to the cost of operation, maintenance, promotion and enhancement services already being performed by the city within the special district. The cost of such additional operation and maintenance of improvements and other additional maintenance, promotion and enhancement services need not be assessed uniformly against properties included within said special assessment district but may be assessed according to a formula established by ordinance which in the sold judgment of the common council reflects benefits accruing to the various properties within the special assessment district.

    The formula as heretofore authorized in this section may provide that all or any class or category which is exempt by law from real property taxation and which would not be benefitted by the establishment or extension of the district may nevertheless be included within the boundaries of the district but such property shall not be subject to any assessments imposed on behalf of the district.
