§ 14-25.1. Miscellaneous provisions.

  • (a)

    Litter containers. Use of these containers by any waste generator other than by individuals disposing of incidental packaging related to individual consumption shall be a violation punishable by a fine of not more than fifty dollars ($50.00) per occurrence.

    (b)

    Littering and dumping. It shall be a violation for any person to engage in littering or dumping on any public property, public right-of-way or private property. Littering shall be punishable by a fine of two hundred fifty dollars ($250.00) for the first offense, three hundred fifty dollars ($350.00) for the second offense, and five hundred dollars ($500.00) for the third and each subsequent offense. Dumping shall be punishable by a fine of five hundred dollars ($500.00) for each occurrence. Dumping and/or littering violations shall be punishable by the aforementioned fines and/or imprisonment not to exceed fifteen (15) days.

    (c)

    [Scavenging and salvaging.] Scavenging and salvaging of city-designated recyclable materials whether placed for collection by D.P.W. or private waste haulers shall be a violation.

    (d)

    [Adopting rules and regulations regarding solid waste.] The commissioner is hereby authorized, with the consent and approval of the common council, to make and adopt rules and regulations regarding solid waste not inconsistent with any city local law, ordinance, or regulation of the commissioner of health for Onondaga County. Such rules and regulations when so adopted and approved shall have the force and effect of an ordinance.
